These Terms of Use ("Terms") govern access to and use of the website v-node.pro (the "Site") and the virtual private server hosting, storage and related services offered through it (collectively, the "Services").
By creating an account, ordering a Service, or otherwise using the Site, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Services. If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity.
You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the legal capacity to enter into a binding contract, to register an account or purchase Services. You are responsible for ensuring your use of the Services complies with the laws applicable to you.
V-Node provides, subject to availability and applicable plan limits:
Services are billed on a pay-as-you-go, prepaid basis. Specifications, pricing and features of each plan are as described on the Site at the time of order and may change for future billing periods with reasonable prior notice.
You must not use the Services to:
We may investigate suspected violations and take action including content removal, suspension, or termination, with or without prior notice, depending on severity.
You retain all rights to the data, applications and content you store or run on your VPS ("Customer Content"). You are solely responsible for its legality, backup, and security. While we may offer snapshot or backup features, you remain responsible for maintaining independent backups of critical data. We do not access Customer Content except as necessary to provide the Services, to respond to abuse reports, or as required by law.
We aim to provide high availability infrastructure, but the Services are provided "as is" and "as available." Scheduled maintenance, third-party infrastructure incidents (including at our upstream data centre provider), or force majeure events may cause interruptions. Any specific uptime commitment applicable to your plan will be set out separately in your order confirmation or a service level agreement, if offered.
The Services rely on third-party infrastructure providers for data centre capacity (including servers located outside Moldova) and on third-party payment processors (Stripe, NowPayments) and communication providers for transactional email. Your use of the Services is also subject to the acceptable use requirements of these providers where applicable.
The Site, its design, logos, and underlying software (excluding Customer Content and open-source components) are owned by the Company or its licensors and are protected by applicable intellectual property laws. You may not copy, modify, or reverse-engineer the Site or control panel except as permitted by law.
To the maximum extent permitted by applicable law, the Company shall not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or business, arising from your use of the Services. Our aggregate liability for any claim relating to the Services is limited to the amount you paid us for the Service giving rise to the claim in the three (3) months preceding the event. Nothing in these Terms limits liability that cannot be excluded under mandatory law, including liability for gross negligence or wilful misconduct.
You agree to indemnify and hold the Company harmless from claims, damages, and expenses (including reasonable legal fees) arising from your breach of these Terms, your Customer Content, or your unlawful use of the Services.
We may update these Terms from time to time. Material changes will be notified via the Site or by e-mail to the address on your account at least [NOTICE PERIOD, e.g. 15 days] before taking effect. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the Republic of Moldova, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the competent courts of [CITY, e.g. Chișinău], Republic of Moldova, unless mandatory consumer-protection rules of your country of residence provide otherwise.
